VILLAGE OF TWIN LAKES AND TOWN OF RANDALL
AGREEMENT
PURSUANT TO WIS. STAT. § 66.0301 (1999-2000)
FOR THE JOINT STUDY AND IMPLEMENTATION
OF A
COMPREHENSIVE PLANNING PROCESS

THIS AGREEMENT is
made and entered into as of this _____ day
of _____________, 2001,
between the Village of Twin Lakes,
Wisconsin
(“Twin
Lakes”)
and the Town of Randall,
Wisconsin
(“Randall”), municipal corporations and political subdivisions of the State of Wisconsin,
pursuant to WIS. STAT. § 66.0301 (1999-2000), and as
may be amended, to establish a relationship for the joint participation of Twin
Lakes and Randall to address and implement a planned and orderly growth pattern
for Twin Lakes and Randall and to create a comprehensive planning process, all
of which recognizes the value of intergovernmental cooperation. Twin Lakes and
Randall wish to implement a multi-jurisdictional comprehensive planning process
in full conformance with state statutes, specifically pursuant but not limited
to, WIS. STAT. § 66.1001 (1999-2000), and as may be amended, that will benefit Twin Lakes and
Randall, individually and jointly.
WHEREAS,
Twin Lakes and Randall desire to participate jointly, and through their mutual
cooperation and joint effort, to enter into this Agreement, pursuant to the
applicable provisions of WIS STAT. § 66.0301 (1999-2000), and as may be
amended, for the purpose of creating individual Comprehensive Plans for Twin
Lakes and for Randall, which will benefit both municipalities.
NOW,
THEREFORE, in consideration of the mutual benefits to be derived from Twin Lakes and
Randall cooperating together in a comprehensive planning process to the end of
creating Comprehensive Plans for each municipality, the parties agree as
follows:
1. That this Agreement shall become effective
when executed by the authorized representatives of both municipalities.
2. That the provisions of this Agreement are
retroactive, and include all actions, acts, authorizations, transactions, facts
and signatures related to obtaining the FY 2001 Comprehensive Planning Grant
Award, and all actions, acts, authorizations, transactions, facts and signatures
as relate to the joint comprehensive planning process of the two (2)
municipalities in response to the Smart Growth legislation, including without
limitation, WIS. STAT. § 66.1001 (1999-2000), and as may be
amended.
3. That Twin Lakes and
Randall have received from the Wisconsin Department of Administration a FY 2001
Comprehensive Planning Grant Award. The
money received from this Grant Award, and any future grant awards,
shall be retained by Twin Lakes, and
all grant money expended, shall be disbursed through the offices and facilities
of Twin Lakes. This grant money shall be expended for the
sole purpose of creating and continuing a joint comprehensive planning process
for Twin Lakes and
Randall.
4. That Twin Lakes and
Randall agree to jointly cooperate and to jointly participate in a joint effort
to create and implement a joint planning process and to create a Comprehensive
Plan for each municipality, which will benefit both municipalities.
5. That Twin Lakes and
Randall agree to request bids to the end of hiring a professional planning
consultant to assist the municipalities in their comprehensive planning process
goals. The professional planning
consultant will advise both municipalities, and will assist in drafting
individual Comprehensive Plans for each municipality. The Twin Lakes Village Board and the Town of Randall
Town Board will approve the professional planning
consultant to be hired, and will approve the Contract with the same. Each municipality will pay the professional
planning consultant for work done on behalf of that particular municipality.
6. That the Twin Lakes Village Board and the
Town Board of the Town of Randall will
jointly meet at least once every six (6) months to discuss issues related to
the comprehensive planning process.
These joint meetings will alternate between the Village Hall and the
Town Hall. These joint meetings are
meant in part to create, foster and strengthen present and future cooperation
between the two (2) municipalities regarding all aspects of working together in
an ongoing comprehensive planning process.
7. That the Twin Lakes Village Board and the
Town of Randall Town Board will
create and appoint a Joint Smart Growth Commission. The Village and Town Boards together will
write the rules, regulations and procedures for the Joint Smart Growth Commission. Each Board will appoint six (6) members to
the Joint Smart Growth Commission, of which at least two (2) members from each
municipality will be citizen members who do not hold any other public
office. More than two (2) citizen
members may be appointed by each municipality.
Each of these twelve (12) members will have
one (1) vote. Each present and future
voting Joint Smart Growth Commission members shall serve a two (2) year term,
and shall not be removed from office during the term except by a majority vote
of a joint meeting of the Twin Lakes and
Randall Boards. Joint Smart Growth Commission
members may be appointed for additional terms of two (2) years.
The Village and Town Boards may also
appoint advisory non-voting members to the Joint Smart Growth Commission, as
for example members representing the Town of Wheatland, the
Town of Bloomfield and Kenosha County.
The Joint Smart Growth Commission shall be
given all powers as agreed by and between Twin Lakes and
Randall. The Joint Smart Growth
Commission, assisted by the professional planning consultant and any other
person requested by the Joint Smart Growth Commission and the Village and Town
Boards, will draft and propose a recommended Comprehensive Plan for each
municipality. The Village Board and the
Town Board may only have the power to approve their respective Comprehensive
Plans as recommended by the Joint Smart Growth Commission.
Any action, recommendation or approval by
the Joint Smart Growth Commission shall be by a unanimous vote of all voting
members present at the time of the said vote.
A quorum shall be nine (9) members.
The purpose behind the unanimous vote is to better ensure that a primary
goal of the Joint Smart Growth Commission is to maintain planning cooperation
between Twin Lakes and
Randall.
8. That this Agreement is effective for one (1)
year from the execution date of the same.
This Agreement shall automatically renew for a one (1) year at the
conclusion of the preceding term, unless within ninety (90) days of the end of
the current one (1) year term, either Twin Lakes or
Randall, in writing, informs the other municipality that the requesting
municipality no longer wishes to participate in this Agreement.
9. That this Agreement may only be changed, in
writing, as agreed by and between Twin Lakes and
Randall.
10. That this Agreement shall be governed and
construed in accordance with the laws of the State of Wisconsin.
IN
WITNESS WHEREOF, the Village Board of Twin Lakes and the Town Board of
Randall have approved this Agreement and have authorized their respective duly
authorized officers to sign this Agreement.
